RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-00569 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His date of rank (DOR) to the grade of major (O-4) be changed to 1 Aug 13. APPLICANT CONTENDS THAT: He was unjustly denied an earlier DOR because his unit is a civilian agency (the Selective Service System) and was not familiar with Air Force procedures. On or about 23 Jul 13, his unit submitted an accelerated promotion request for him with a 1 Aug 13 DOR. The request was returned twice for corrections. Therefore, his promotion DOR defaulted to his original DOR of 24 Jan 14. The requested DOR of 1 Aug 13 should be honored because that was the intent of his leadership. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air Force Reserve on 27 Aug 99. On 14 Jan 13, the applicant was selected for promotion to the Reserve grade of O-4, at the Calendar Year 2013 Air Force Reserve Line and Non-line Major Mandatory Promotion Selection Board. Under Reserve Order BA-14457, dated 27 Dec 13, the applicant was promoted to the grade of major, effective 24 Jan 14. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: ARPC/PB recommends denial indicating there is no evidence of an error or an injustice. On 11 Dec 13, ARPC/PBE received a request for accelerated promotion from the applicant, dated 20 Nov 13, requesting a 1 Dec 13 DOR. The request was returned for corrections. Subsequently, ARPC/PBE received a request from the member, dated 23 Jul 13, requesting an earlier DOR of 1 Aug 13. Per AFI 36-2504, Promotion, Continuation and Selective Early Removal in the Reserve of the Air Force, an accelerated promotion request must be received from the senior rater and not from the member on his own behalf; the request must be received by ARPC/BCE at least 2 business days before the proposed DOR; and the officer must occupy a position with an authorized grade higher than the officer’s current grade. However, the request in question was received directly from the member instead of the senior rater; was not received until four months after the requested effective date; the applicant was not in a higher grade position than his current grade; and, the senior rater who endorsed the application was not the senior rater for the unit the member was assigned to. A complete copy of the ARPC/PB evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 Jul 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
